TERMS OF SERVICE

By accessing the Service, clicking "I agree", registering an account, or making a purchase, you enter into a binding legal agreement with KickPulse. These Terms apply to all users, including visitors, registered users, and subscribers.

You represent that you are at least 18 years of age, or the age of majority in your jurisdiction, and that you have the legal capacity to enter into these Terms.

KickPulse provides software tools that simulate viewer presence on live streams on the Kick.com platform using automated connections ("Bots"). The Service is provided strictly for entertainment and testing purposes only.

KickPulse is an independent service and is not affiliated with, endorsed by, or sponsored by Kick.com or its parent companies.

You must:

• Be at least 18 years old
• Provide accurate registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorised account access
• Not share your account with others or create multiple accounts

You are fully responsible for all activity that occurs under your account, whether authorised or not.

You agree to use the Service solely for lawful purposes and in accordance with these Terms. You acknowledge that:

• It is your sole responsibility to assess whether using the Service complies with Kick.com's Terms of Service and any applicable platform rules.
• KickPulse makes no representation that use of the Service is permitted under Kick.com's Terms of Service.
• Any consequences arising from your use — including but not limited to account suspension, ban, or loss of monetisation on any platform — are solely your responsibility.
• The Service must not be used for any illegal purpose, including fraud, deception, or manipulation of platform metrics for financial gain in a manner that violates applicable law.

You must not:

• Use the Service to violate any applicable law or regulation
• Attempt to reverse-engineer, decompile, or extract the source code of the Service
• Resell, redistribute, or sublicense the Service without our written consent
• Use the Service to harm third parties or interfere with other users' experience
• Submit false, misleading, or fraudulent information to KickPulse
• Circumvent or attempt to bypass any security measure of the Service
• Use automated tools to access the Service beyond their intended purpose
• Use the Service for any activity that constitutes advertising fraud under applicable law

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, KickPulse expressly disclaims all warranties, including:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• That the Service will be uninterrupted, error-free, or secure
• That defects in the Service will be corrected
• That the Service will meet your expectations or produce any specific results
• That using the Service will not result in consequences from third-party platforms (e.g. Kick.com account bans)

To the maximum extent permitted by applicable law, in no event shall KickPulse, its owners, employees, or agents be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, goodwill, or other intangible losses
• Damages arising from your use of, or inability to use, the Service
• Any third-party actions, including platform bans or account restrictions
• Any unauthorised access to or alteration of your data

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, our liability shall be limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless KickPulse and its owners, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or in any way related to:

• Your access to or use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party, including Kick.com
• Any content you submit through or in connection with the Service
• Any claim that your use of the Service caused damage to a third party

All purchases are processed securely through Stripe. By purchasing a subscription, you agree to:

• Pay all applicable fees as displayed at the time of purchase
• Provide accurate billing information
• Accept that subscriptions are for a fixed duration and begin immediately upon activation
• Accept that subscription time is not paused or extended due to stream downtime on your part

Pricing may change at any time. Changes will not affect active subscriptions already purchased. Please refer to our Refund Policy for information on refund eligibility.

KickPulse reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or abusive behaviour
• Actions that damage the reputation or infrastructure of KickPulse
• Legal requirements or law enforcement requests

Terminations for violation of these Terms will not result in a refund. Upon termination, all active subscriptions are cancelled immediately.

You may terminate your account at any time by contacting us.

We reserve the right to update these Terms at any time. We will notify registered users of material changes via email or a prominent notice on the Service. Your continued use of the Service following the posting of updated Terms constitutes your acceptance of such changes.

We recommend reviewing these Terms periodically. The "Last updated" date at the top of this page indicates when the most recent revision was made.

These Terms are governed by applicable law. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the competent courts.
